Force-placed mortgage insurance when the homeowner already has insurance, resulting in false credit reporting and violations of the Real Estate Settlement Practices Act. Defendants are Newrez LLC, a mortgage servicer, plus the credit bureaus.
Plaintiff alleges that Newrez wrongfully imposed lender-placed insurance (LPI), failed to properly credit Plaintiff’s timely mortgage payments, and falsely reported Plaintiff’s alleged delinquencies to credit reporting agencies, knowing such information to be inaccurate. Plaintiff further alleges that TransUnion, Equifax, and Experian failed to reasonably investigate and correct the inaccurate information, thereby exacerbating the financial and reputational harm caused to Plaintiff.
